4. Basic Requirements

Advanced Phone Cleaner comprises certain features that may result in partial or complete removal, deletion of files and uninstallation of other apps temporarily or permanently. 7. License

Use of the object code version of the application for non- commercial purposes is subject to restricted and limited rights. However, you are permitted to create a single archival copy of object code for backup purposes.

In no events, you are permitted to violate any of the obligations and rights mentioned in this TOU. In case of any attempt or reach of obligations under this TOU your rights of usage will be terminated. Upon termination, the original, as well as archived copies, must be destroyed. 8. Infringement Indemnity

Advanced Phone Cleaner shall not be liable for any claims against losses, damages, costs and expenses inclusive of reasonable attorney’s fees, arising out of or relating to any misuse by the User of the services and content provided on the application or website.

9. No Warranty

Advanced Phone Cleaner holds no warranty of error-free or uninterrupted operation of the application for the cases but not limited to, as mentioned below:

• modification of the application without prior approval in writing by Innovana Techlabs Ltd. authorities.
• the error generated from abuse or misuse, accident, damage and neglect or
• vulnerability to unauthorized operating and power settings.

10. Limitation of Liability

Advanced Phone Cleaner will not be responsible in any manner for any warranty that is mentioned outside of this TOU. Advanced Phone Cleaner, its subsidiaries or affiliates shall not be liable for any warranties including that of merchantability which is not mentioned in this TOU.

Advanced Phone Cleaner in no circumstances shall be liable for any losses or damages and causes of action regardless of the basis of the claim unless permitted by law.

Any end user shall not at any time use our trademarks and other proprietary rights as a part of any style or domain name, business or trading name until and unless same is provided by you and Advanced Phone Cleaner in prior written consent.

However, if you as a copyright owner have good faith that any of the content infringes or interfere with any intellectual property, you may submit the notice to the Digital Millennium Copyright Act (“DMCA”) and provide us with the information mentioned below:

• Signature (physical or electronic) of the authorized representative that will act on behalf of the owner of an exclusive right is allegedly infringed.
• A clear description of the intellectual property that has been allegedly infringed.
• Statement of description about how copyright has been allegedly infringed.
• Statement that proves the accuracy of the above information under penalty of perjury and that you are the copyright owner of the same

At Advanced Phone Cleaner, we respect the intellectual property rights of others and strive to act very fast to clear all such alleged infringement notice. However, you shall agree that failure to comply with the mentioned requirements in this section may declare your notice to be invalid.

12. General Terms

This Terms of Service shall comprise the whole agreement between you and Advanced Phone Cleaner. This agreement replaces any or entire written and oral representations, negotiations, proposals and communications made outside of it.

Advanced Phone Cleaner shall not be liable for failing to fulfil its obligations as a result of circumstances beyond control including but not limited to acts of civil or military authorities, floods, fire or accidents, riots or terrorism. BY using the application, you provide your consent that Advanced Phone Cleaner shall imply all equitable and legal remedies to secure its intellectual property and Confidential Information.

13. Settlement of Disputes

You agree to make the first contact with us and attempt to resolve any dispute with Advanced Phone Cleaner informally. We shall resolve any or all the disputes emerging in regards to this Agreement under guidelines of Google Play.

This TOU is governed and interpreted under the laws of India. All legal suits related to this TOU will be settled under the state courts located in,, India. By accessing our application, you agree to the jurisdiction of the courts in India.

14. Disclaimer
